The Phenomenon of "People's Court"


      The phenomenon of "people's court" could be a signal of the existence of the freezing element. Eigenriclzting or vigilantism conducted by Prof. Sudikno Mertokusumo is defined as an act to exercise rights according to his own will that is arbitrary without the approval of other interested parties (Mertokusumo, 1996: 23), seems to be an answer to distrust of the social system that we have built so far that is manifested in the rules of life. having a state and community life through a set of norms, rules and formal legal regulations of state legislation. People who in their daily form are known as the masses, both in groups and en masse, in "prosecuting" perpetrators who are suspected of upsetting and disrupting people's lives, are generally based more on emotional feelings for a moment with the most uncompromising treatment. So that, of course, there is certainly no chance to solve it by KKN or bribery as is the custom of most law enforcers so far. 
       Professor Donald Black (in The Behavior of Law, 1976) formulated that when social control by the government which is often called the law does not work, then other forms of social control will automatically appear (Ali in Kompas 26/06/2002). Like it or not, the actions of individuals and masses from the juridical perspective can be classified as acts of vigilante (eigenrichting), in essence a form of social control by the people. The practice of "people's court" which is no longer a phenomenon, but which has been increasingly strengthened in the traditions of this society, should at least be used as a very strong whip for the nation's leaders, people's representatives who are given the mandate for it and especially to the enforcers and lawyers in this country.
